Like any mode of transportation, shared rides aren’t perfect. With an increase in Share autos and cabs, accidents can still occur. While daily travelers might understand what rideshare is, some might not. So, let us first understand what is ride-sharing?
Ridesharing is nothing but a service that arranges one-way transportation on short notice with one or more passengers from different locations. These ride-sharing options mainly are available in autos and cabs via websites and mobile apps.
Rideshare refers to a service that connects drivers with passengers that need transportation. It’s like a taxi service, except the drivers are freelance employees using their cars.
For example, if one selects a ride from an apartment in Indiranagar to Church Street, by opening up the app, requesting a ride, and waiting for the respective ride to arrive, most of the work is done.
Once the respective location arrives, the driver drops you off at the given destination, the money can be paid via credit card, debit card, UPI /Net Banking, Cash, etc.
Who is responsible for a Rideshare accident?
Whether you’re a passenger traveling a rideshare vehicle or the driver of a vehicle that collides with a rideshare vehicle, liability will generally depend on who’s at fault for the accident.
Usually, the driver or the third party controlling the driver is responsible for the accident caused. Normally, it is never a passenger’s fault. To prove that one of them was at fault (i.e. negligent) for a car accident, you must prove 3 elements:
The person owed a duty of reasonable care like every driver should obey traffic rules and regulations with proper safety measures.
The person breached that duty (the other person didn’t drive carefully or didn’t obey a traffic law).
You were hurt or injured and suffered a lot of damages as a result of the other person’s breach.
Determining fault in a rideshare accident case is just like determining fault in a regular car crash. What makes rideshare accidents a little different is the role insurance plays when the injured party seeks reimbursement from the at-fault party.

Are rideshares dangerous?
Rideshare services offer economical, flexible, and convenient because they often cost less than using a traditional taxi or driving an own vehicle. Nevertheless, there are concerns about how the services operate under the service operational companies, including how well they screen their drivers with experience and driving skills tests.
Even though there have been several instances where passengers have been assaulted and even murdered after getting into a vehicle that they believed to be a rideshare vehicle, that turned out to be a person posing as a rideshare driver.
There is also some evidence that rideshare services are making the roads even more dangerous.
In the years before Uber and Lyft were launched, fatal car accidents were at record lows. However, the arrival of ridesharing is associated with an increase of 2-3% in the number of fatal accidents, according to researchers John Barrios of the University of Chicago.
