Can I leave the mediation process at any time?

Any side may end the mediation at any time. We may also stop the process if we decide that doing so would be improper or ineffective. In any instance, we will provide you with details on further options.

A mediator is impartial.

As mediators, we are impartial and make an effort to support each party equally. We do not make conclusions about who is right or wrong, or express opinions or take sides. We encourage you to make independent decisions about your future. We are about to deliver factual and impartial information regarding mediation, despite the fact that we are unable to offer legal advice.

Do I require a lawyer?

A mediator can help you understand your options by providing impartial legal and financial assistance. You make the decisions, and we don’t evaluate your particular situation or the sum of your circumstances or make recommendations in your “best interests.” We’ll help you both. We will work with you both to assess the options in light of reality and will discuss with you which solutions might be the most suitable for you and your family. If it appears that your suggested remedies go beyond what a judge may permit, we will discuss this with you. You can speak with your lawyers before or during the mediation process, which is often highly advantageous and allows you to make informed decisions. Your respective counsel may also be informed of the mediation’s development if you’d like.

Is mediation open and truthful with all parties?

You two will be free to share any information, including communications from either of you. An address, phone number, or email address that one of you wants to keep private is the lone exception.

If we have prior knowledge of the issue as a result of our prior involvement as a barrister or in another professional role, mediation cannot take place. We will no longer be allowed to act as mediators if a conflict of interest or apparent conflict of interest arises in the future.

The mediation process is FREE for you if you qualify for legal aid or public financing (we will determine this), and the other party would also profit from your legal assistance since they would receive the initial assessment meeting and one mediation session at no cost.
